Buyer Agency
Electing a mutual agreement creates a buyer agency relationship between us which obligates us to include the following client level services:
· Loyalty · Obedience · Disclosure · Confidentiality · Accounting in dealings
In comparison with the typical sub-agency transaction, where the buyer is not technically represented, I will represent both you and your interests in the purchase of your home.
The sales agent, however, has the duty to perform reasonable skill and care in performing the duties of the Broker. Such duties include fairness and honesty, and the disclosure of all known facts to the Broker. Such facts of which materially and adversely affect the property’s considered price.
There may be a situation where a dual agency can arrive. This essentially occurs if we enter with another property listed with our company. It is a challenging situation because of the difficulty to afford full client level services to both parties.
A written agreement must be entered between the buyer and seller for the possibility of dual agency.
A written agreement must be completed stating all responsibilities and duties and explaining the legal relationship of Agency.
